Severability

The failure of Elementary to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, unless acknowledged and agreed to in writing by Elementary.
This Severability clause ensures that if any provision of the Terms is deemed invalid, illegal, or unenforceable, it will not affect the validity and enforceability of the remaining provisions. The clause also establishes the intention to replace any invalid provision with a valid one to maintain the original intent of the Terms. It further clarifies that the invalidity of a provision does not invalidate the entire Terms, and that Elementary’s failure to enforce any right or provision does not waive its right to enforce such provision in the future, unless explicitly stated otherwise in writing.
Waiver
Elementary’s failure to enforce any provision of these Terms of Service shall not be deemed a waiver of such provision or of the right to enforce it in the future. Any waiver of any provision of these Terms of Service will only be effective if it is in writing and signed by an authorised representative of Elementary.
The waiver of any breach or default under these Terms of Service will not constitute a waiver of any subsequent breach or default. No waiver by Elementary of any right under these Terms of Service will be deemed to be a waiver of any other right or provision.

- Limitation of Liability: The provisions limiting liability and disclaiming warranties shall remain in effect to the extent permitted by applicable laws, protecting both Elementary and users from potential claims and damages.
- Dispute Resolution: The provisions governing the resolution of disputes, including choice of law, jurisdiction, and dispute resolution processes, shall survive to resolve any claims or disputes arising from the use of Elementary’s services.
The survival of these provisions ensures the ongoing protection of rights, obligations, and legal remedies even after the termination or expiration of the agreement, maintaining clarity and continuity for both Elementary and its users.
Force Majeure
In the event that either party is unable to perform its obligations under these Terms of Service due to circumstances beyond its reasonable control, such as acts of God, natural disasters, fires, epidemics, governmental actions, or any other events that are unforeseeable and beyond the control of the party (“Force Majeure Event”), the affected party shall be excused from performance during the continuance of the Force Majeure Event.

During the Force Majeure Event, the obligations of the affected party that are affected by such event shall be suspended for the duration of the Force Majeure Event. The party experiencing the Force Majeure Event shall take all reasonable steps to mitigate the effects of the event and resume full performance as soon as reasonably practicable after the event ceases.
